Drink Drive Case Notes
Authors: P. M. Callow
Publisher: Callow Publishing Ltd, 2002 - ISBN: 1898899606
The book, written in association with Lion Laboratories ltd, comprises nearly 500 summaries of cases on the drink-drive laws which have come before the high Court, the Court of Appeal and the House of Lords. Many of the cases, which cover a period from 1984 to July 2002, have not been reported elsewhere. Each case note is presented as a short statement of the facts of the case; the question(s) put to the higher court and an extract from the judgement. The notes are intended to provide a broad outline of the trends in the case law and provide a starting point for readers seeking guidance on particular points.
Features covered include:
- the requirement to provide specimens; unreliable breath analysis device; medical issues
- replacement specimens: lower breath readings; reasons why blood cannot or should not be taken
- failing to provide specimens
- challenging the breath testing and analysis devices
- evidence; admissibility of the printout and of the breath analysis; single specimens
- definitions
- defences; no likelihood of driving; premature disclosure of defence
- others issues, including proof of driving, legal aid and the prosecution case.

Drink Driving Law & Practice
Authors: Joseph Nigel Ley
Publisher: Sweet & Maxwell; 1996, 2nd Edition - ISBN: 0421580607
Since the last edition the law has progressed rapidly. Here all the relevant statutory provisions are set out and analysed in detail, with special emphasis on how these provisions have been interpreted by the judiciary. Important cases on duplicity and the provision of body samples are included as well as provisions of the Road Traffic Act, 1991. This Act introduced the offence of causing death by careless driving while under the influence of drink or drugs, and changed the "totting up" provisions. Another major development has been the application of section 69 of PACE, 1984. This applies to the breathalysers used at the police station and to the admissibility in evidence of the breathalyser printouts. The book also explains clearly how samples are analysed, the technology involved in the Lion Intoximeter and Camic devices, and the medical effect of alcohol on the human body.
